In the competitive business world, intellectual property has become one of the most valuable assets. Most successful businesses or products start with an idea. You may want to take steps to ensure that your idea doesn’t fall into the wrong hands or get misused, before you decide to go public with it.
1) Who and What – It is completely normal when you get excited about a new idea to share it with someone. Be careful about the details, and ensure that only the necessary people are involved. Keep a list of the people you have shared it with and the details to a minimum.
2) The Lawyer – An IP Lawyer is the best person to help you with your IP rights. You may not be able to understand the provisions of law and therefore an IP lawyer will be able to advise you on matters regarding patents or copyrights and will advise you on the best way to keep your IP safe.
3) Knowledge is Power – It doesn’t hurt to read up on your IP laws even if you have a legal expert handling your IP issues. It will help you recognize what the necessary steps you may want your lawyer to take with regards to safeguarding your IP if you have a basic understanding of the legal framework. Don’t be afraid to ask question and make sure your lawyers keep you updated on any necessary changes and developments.
4) Plot The Plan – Make sure you have studied all the aspects of your idea before you show it to the world. Research your idea and take your time. The right people will notice a well-planned and thorough idea. Most importantly, research to ensure you haven’t ‘copied’ or imitated another idea.
5) The importance of NDA (nondisclosure agreements) – You may find that during the process of realizing your idea, you may have to share it with potential business partners, investors or even third-parties. There is an agreement that can be signed that stipulates no confidential information shall be disclosed without the prior consent of the creator. It is called a nondisclosure agreement (NDA).
6) Patent It – Don’t wait until your idea is complete before you patent it. Consult your IP lawyer on the best time to patent your idea, what the best protection should be and make sure you have all your documentation complete.
Putting the proper procedures and steps in place will not only ensure the safety of your intellectual property but will also see to it that your hard work doesn’t get stolen.
